Is there any Plan for an Independent Audit?

There are so many questions regarding irregularities in the disbursement of Settlement funds–Gilardi appears to be on the brink of failure, we are kept in the dark, last minute requests for IRS rulings, promise after promise after promise, yet delay after delay after delay —

Maybe there needs to be an Independent Audit of How the Settlement Fund Money is being Disbursed?

The Plan of Allocation and Distribution Order (court Document 639-1) provides general instructions for how the funds are to be disbursed, but who is giving Gilardi the detailed instructions needed to fill in the gaps–such as, which bills submitted for payment are legitimate charges against the Fund, special payment instructions to those providing services (e.g., our fast and efficient tax specialists)?

Who is choosing the tax specialists and others which are getting paid from the Fund? Who is the ultimate “boss” who is directing how the Fund is dispersed? Is it IAM boss Rooney? Is it SPEEA director Bob Brewer? Is it IAM or SPEEA general counsel? Is it our lead attorney Arlus Stephens? Is it our local attorney Tom Hammond? And, if it is one of the attorneys, remember  an attorney is responsible to his “client” and takes instructions from the “client”. So, who is the ultimate “client” of the attorneys who gives them their marching instructions? We know it is not any of the Class Members. Is it Rooney, Brewer, another higher up IAM or SPEEA union official or counsel? Is it one or more of the Named Plaintiffs (our “Class Representatives”)? WE NEED TO BE TOLD THIS INFORMATION, otherwise there is not full disclosure. We need to see if there are Conflicts of Interest (in addition to the conflicts of interest the unions and attorneys may have). We know the judge is not giving the day-to-day directions of how Gilardi is to pay out our money.

There should be an Independent Audit of the Settlement Fund to determine:

1. Are the funds still there?

2. Is the Settlement Agreement being followed regarding how the funds are disbursed.

3. Disclosure of the formulas used to determine each Class Member’s share?

4. Are there any suspicious disbursements or charges to the Fund?

5. Are the rules being changed as we go along to allow payouts which were previously not allowed?

6. Exactly how are the attorneys’ fees being disbursed to the attorneys and how much to which attorneys?

7. What is the mechanism by which the attorneys are kicking back the fees the unions paid them? Who are these checks made payable to? In what amounts?

8. Who authorizes the payments–Who signs the checks?

9. After all the money is paid out, does it add up to $90 million, or did a couple of million go missing?
